| 内容記述 | Although Japan does not yet have an Ombudsman system, it has been studied for twenty years. This paper classifies the studies into three periods, arranges the studies of each period, and presents some theoretical questions for the future, such as why a study on the nonexistant Ombudsman system is relevant today. To this there are two answers: 1) The pros and cons of the system are becoming more and more divided, and 2) The Government has begun to study the system in real earnest. As the fundamental principles of modern constitutionalism are "clearly defined power" and "consultation in the committee", this writer shows particular interst in the problem of concentratiog so much power in the individual Ombudsman system, which lies emphasis on his "personality" and "authority". The conclusion of this paper is that the Ombudsman system is the son of the contradiction of modern constitutionalism. | |||||||
